Wills

It is very important for everyone to make a Will. The law of intestacy (dying without a Will) can be complex and may not reflect your wishes.

A Will can provide for so much more than just your financial assets; you may wish to appoint Guardians to your children or make funeral arrangements.

Ensuring that you have an up to date Will gives you and your family security and peace of mind that everything is in order. It is also essential to regularly review your Will particularly if there is a change in your personal circumstances. We provide comprehensive advice on the preparation of Wills.

Powers of Attorney

Many are unaware of the terms of the Adults With Incapacity (Scotland) Act 2000 and its implications for those wishing to deal with the finances and/or welfare of friends and relatives. A Power of Attorney allows you to appoint someone you trust to deal with your affairs if you become unable to do so. It is important that consideration is given to such matters before an adult becomes incapacitated rather than after the fact. In much the same way as making a Will, matters can often be easier for relatives or others by granting a Power of Attorney at an early stage. We can provide advice in this regard and assist you in the preparation of a Power of Attorney and with dealing with the Office of the Public Guardian for Scotland.

Executries

Suffering a bereavement is a very difficult and emotional time and it can be stressful dealing with the administrative task of winding up an estate. We can provide assistance and help ease the burden to those who require to wind up the financial affairs of someone who has recently passed away including preparing and submitting documentation to HMRC and the Sheriff Court if required. Attending to an Executry can often be a lengthy and complicated process. We can help with all aspects including payment of inheritance tax, sale and transfer of heritable property, legal rights claims and the distribution of an estate.
